A one-million dollar wrongful death lawsuit has been re-filed against the city of Canton and officers in the fatal shooting of James Williams.

Williams’ widow, Marquetta Williams, re-filed the suit alleging that excessive force was used in the Jan. 1, 2022 killing of Williams.

Williams was ringing in the New Year by standing on the porch of his house on 10th St and firing celebratory shots into the air, according to court records. Williams was shot by Canton Police Officer Robert Huber.

When Huber arrived to the scene, heard the gunfire and proceeded to shoot through the fence, killing Williams, according to records.

Huber faced no discipline for the shooting after an internal review, deeming he did not violate any department policies.
